Our terms and conditions apply to all online conditions of sale from our web site, which is owned & operated by Eleisure Enterprises Ltd. The terms are set out below. Read them before ordering. You may wish to print a copy for future reference. Other terms and conditions on our site such as our privacy policy should also be read as part of this agreement. We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.

1. Your Account

If you use this web site, you are responsible for maintaining the confidentiality of your password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure. You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the My Account area of the web site.

Eleisure Enterprises Ltd reserve the right to refuse access to the web site, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

2. Privacy Policy

Eleisure Enterprises Ltd is committed to protecting your privacy.

We will only use information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

We are registered under the Data Protection Act 1998 and comply with the Act in all our dealings with your personal data.

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

We will never share personal information with third parties unrelated to us.

Credit card information is recorded by use of a secure SSL server using 128-bit encryption as used by most of the worlds banking organisations.

For the security of our customers, we do not store credit card numbers. Credit card numbers are only passed on to our payment service provider (metacharge).

The information we hold will be accurate and up to date. You can check the information that we hold about you by writing to us. If you find any inaccuracies we will rectify the error as soon as possible.

The personal information, which we hold, will be held securely in accordance with our internal security policy and the law.

3. Access to Eleisure Enterprises Ltd web-site's

We will make all reasonable endeavours to ensure that availability of the web site will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet and the World Wide Web, this cannot be guaranteed. Also, your access to the web site may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

4. Licence for Web Site access

Eleisure Enterprises Ltd grant you a limited licence to access and make personal use of this web site, but not to download (other than page caching) or modify it, or any portion of it, except with the express written consent of eLeisure Enterprises Ltd.

This licence does not include any resale or commercial use of this web site or its contents;

Any collection and use of any product listings, descriptions, or prices; any derivative use of this web site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

This web site or any portion of this Web site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

5. Our contract

When you place an order to purchase a product from Eleisure Enterprises Ltd, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product, which is accepted by us when we send e-mail confirmation to you that we have dispatched that product to you. That acceptance will be complete at the time we send the confirmation of shipment to you. Any products on the same order, which we have not confirmed as being shipped do not form part of that contract.Eleisure Enterprises Ltd reserves the right to cancel an order up to the point of delivery.

6. Pricing

All prices quoted include VAT at the current rate, where applicable.

7. Back Orders

If for any reason, we are unable to deliver your order within 5 days, we will contact you & give you a choice of putting your order on to our back order system or offer a full refund.

8. Electronic communications

When you visit the Eleisure Enterprises Ltd web site or send e-mails to us, you are communicating with us electronically. We often communicate with you by e-mail or by posting notices on the web site.

For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

9. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our web site, policies, and these conditions of use, at any time.

You will be subject to the policies and conditions of use in force at the time that you use the web site. Or when you order goods from us.

Unless any change to those policies or these conditions is required to be made by law or government authority, (in which case it will apply to orders previously placed by you).

If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed saleable and will not affect the validity and enforceability of any remaining condition.

10. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause, which is beyond our reasonable control. This condition does not affect your statutory rights.

11. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

12. Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

14.Returns Policy (UK only)

If any of our products fall below the high standards you expect, or you would like to exchange your item within 28 days of your purchase, we will happily refund or exchange.

For all faulty received goods, we will refund all return postage costs* paid (see below) if the product is still within the six months guarantee period & that you have also followed any product care either provided with the products or available online at our website). We cannot accept liability for any damage to products we have supplied which is caused by your failure to follow this advice.

You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods. For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen Advice Bureau.

We are under a legal duty to supply products that are in conformity with these Terms. This means that the products must be as described, fit for purpose and of satisfactory quality. If you purchase a product online which is found to be faulty within 28 days of receipt then your legal rights entitle you to request a full refund of the faulty Product. Should a fault occur after the initial 28 days but before the expiry of 6 months of receipt of the Product, we are entitled to repair and/or replace that item. If it cannot be repaired or replaced, then you may be entitled to a refund.

If you wish to exercise your legal rights to reject Products because they are faulty or mis-described you must post them back to us or (if they are not suitable for posting because they are too heavy or too large) allow us to collect them from you. If you no longer have the delivery note or receipt for the Products, please contact us.

For faulty Products, we will examine them or we may have to return them to the manufacturer for examination. Where applicable, if an item can't be either repaired and/or replaced, a refund will be provided to you within 14 days of the day that we agree that you are entitled to a refund.

Returned items must be with Royal Mail First Class Recorded or Royal Mail Standard Parcels. If an item weighs more then 2kg please use Royal Mail Standard Parcels Service. If posting an item back to us please retain proof of posting.

If returning for an exchange or other reason other then above, you will have to pay the cost of returning the goods to us. We will pay for the postage cost of an exchange when we post it back to you.

Returns 14 day cooling off period:

Under the new European Directive on distance selling (which is incorporated into UK law by the Consumer protection, Distance Selling Regulations 2000) you have the unconditional right to cancel your order within 14 working days without having to give a reason. The 14 working days start from the day after the day that you receive the goods at the designated delivery address. We will provide a full refund for the purchase price of the goods (minus a 2.5% credit card processing fee, which is non-refundable. We will not refund any delivery charges (If delivery has been made). In order for us to provide a refund, all goods must be unopened and in perfect condition (AS NEW). We unconditionally reserve the right to not refund if the goods are not returned in a suitable condition.

Please note that if you exercise this right, you will have to pay the cost of returning the goods to us with a sign for service.

Where you exercise this right to cancel, we undertake to refund your money within 7 days of receiving the goods back into our warehouse. We will refund you by the same method as your original payment.

*Postage cost will be determined by weight of item and calculated for either First Class Recorded Post or Royal Mails Standard Parcels using Royal Mails current prices as displayed either on their company website or printed booklet. Please note: If any other postage option used, we will not cover any additional costs incurred either when using Royal Mail or any other courier.
